The Agreement Subject   1.5 The present Agreement regulates the Labor relationship between the Employee and the Employer 1.6 The Employee is employed on a position of Administration Senior Manager (to point out position, profession, qualification) 1.7 The place of work is _______________________________________ (name of the corresponding department) 1.8 The work according to the present Agreement is (X) the main working place of the Employee () a combining with other work 2. Duration of Employment 2.1. The present Agreement is effective from ___. The pointed out date is a date of work starting.   2.3 When concluding the labor Agreement the test period for the Employee is fixed for the period of __ months. The test period is included to the period of validity of the present Agreement, does not break and stop it. 2.2.3. If after the test period expiration the Employer does not issue the order about the Employee discharge from the current position in connection with unsatisfied results of the test and the Employee continues the work he is considered as passed the test and the further Agreement cancellation is allowed basing only on the regulations fixed by the legislation.   2.2.4. In case of the unsatisfied test result on the last day of the test period the Employer issues the order on discharge of the Employee from the position in connection with the unsatisfied test results, the HR department issues the order on discharge and let it know to the Employee taking his sign for it. The Employer is obliged to pay the Employee a salary for the worked time. The present Agreement is considered as cancelled from the date stated in the order.   2.2.3. If during probation period the Employee decides that offered job is not suitable for him, he can terminate the labor Agreement on his own initiative. Party, which terminates the Agreement, must notify the other Party in a written form 3 days before the Agreement is supposed to be terminated.   3. Employee RIGHTS AND Duties 3.1. The employee has the right for: 3.1.8. Concluding, changing and cancellation of the labor agreement in accordance with conditions and procedures stipulated by the Labor Code; 3.1.9. Provision of work stipulated by the labor agreement;   3.1.10. Timely and full payment of salary in accordance with his qualification, labor complexity, quantity and quality of the fulfilled work; 3.1.11. Rest, provided by settling of normal duration of working time, allowance of weekly non-working days, holidays and paid annual leaves;   3.1.12. Obligatory social insurance in cases, stipulated by federal legislation; 3.1.13. Protection of his labor rights, freedoms and legitimate interests by all means, which are not prohibited by the law; 3.1.14. Full and reliable information about labor conditions and requirements of labor protection on the workplace. 3.2. Employee is responsible for the following: 3.2.1. The Employee executes the position obligations specified in the Exhibit A of the present Agreement forming an integral part of this Agreement; The Employee fulfills tasks with the highest possible responsibility and does not evade from performing the tasks set by the Employer in the frames of obligations specified by this Agreement;   3.2.2. The Employee agrees to devote all his labor hours, full attention and energies to the business of the Employer; The Employee conforms to the Employer's business goals with the best of his or her knowledge and capability; 3.2.3. The Employer is the proprietor of all copyrights on subjects of intellectual property developed or created by the Employee during his or her employment within the frame of this Agreement. On terminating this Agreement for any reason the Employee is obliged to hand in all developed materials (or) developing materials to the person indicated by the Employer; 3.2.4. The Employee undertakes no actions that will cause harm to the Employer or which will in any way injure the reputation of the Employer; The Employee undertakes to be at all times loyal to the interests of the Employer and give priority to the interests of the Employer such that all actions of the Employee shall be taken exclusively in the interests of the Employer rather than out of interests of third parties; The employee undertakes not to be involved in activities which hinder normal business operations or prevent other Employees from fulfilling tasks set by the Employer, 3.2.5. The Employee strictly maintains labor and production discipline, abide by labor protection and industrial safety requirements, labor hygiene, and fire-prevention regulations as per relevant instructions; The Employee observes the Set rules of conduct and business ethics of the Employer;     3.2.6. The Employee obtains job changes and promotions in accordance with business projects of the company. In this case when area of duties are changed they are to be done with the consent of the Employee and to be legalized in an additional agreement;   3.2.7. The Employee reports in written form about the work done in the period and by the order fixed by the direct management   4.3.Material Responsibility 3.3.4. The Employee agrees to take all reasonable measures to protect the property and property interests of Employer from theft, pilferage, damage, or spoilage, and to be responsible for any of Employers property over which control is exercised. 3.3.5. The Employee agrees not to make use of business properties of the Employer at will or without written consent of the Employer, be it physical or intellectual.   3.3.6. Material Responsibility Legalization () Employee shall sign the attached Material Responsibility Agreement, Exhibit B, which is considered an inseparable part of this Agreement. (x) Full material responsibility is not applicable.   5. the Employer Responsibilities The Employer agrees: 4.7. to provide all conditions necessary for performance by the Employee of obligations taken by him or her in the frames of this Agreement; 4.8. that it does not have the right to demand from the Employee to perform work which is hazardous to life and health; 4.9. that in cases of urgent necessity the Employer can transfer the Employee to any job not mentioned in the Agreement only by the consent of the Employee for the period and terms provided by the labor legislation of Russian Federation; 4.10. Pay the salary due to the employees in full within time periods, stipulated by the Code and internal regulations of the organization; 4.11. Provide obligatory social insurance to the employees according to the procedures, stipulated by federal legislation; 4.12. Pay all the expenses connected with business trips of the employee; Duration and conditions of the business trip are determined by concordance between the Employer and the Employee.     5.Compensation. 5.4. The Employer agrees to pay the Employee a salary in the amount of ________per month (net). Net amount (taxes deducted) to be transferred to the personal bank account of the Employee, or in other form as permitted by current legislation. 5.5. To stimulate the interest of the Employee the Employer can increase salary, give periodic bonuses in accordance with internal policies, and make other financial incentives.   5.6. The Employee will be compensated for any overtime work, as well as work on weekends and public holidays in accordance with the applicable legislation. Compensation will only be given if such work is expressly authorized by the Employer     6. Hours of Employment:   6.2 The Employee is (check one): (x) Full Time - The Employee's working week shall be five (5) days per week [Monday through Friday] and shall be forty (40) hours. Working hours, breaks and meal times shall be determined by the Company Internal set of rules and regulations.   () Part Time - The Employee's working week shall be ________ hours per week _________________________ (specify hours and days). In addition to Saturday and Sunday, the Employee shall be entitled to all Russian public holidays fixed by the current labor legislation.   13. Vacation   The Employer shall grant to the Employee an annual paid vacation of twenty eight (28) calendar days once the Employee has worked for six months. Vacation shall not be replaced by monetary compensation except when dismissed the Employee did not use up his leave. For employees working less than six months, paid vacations will be at the discretion of company management.   Under the agreement between the Employee and the Employer the vacation can be divided into parts with at least one indivisible part equal to not less than 14 days     14. Confidentiality The Employee shall maintain all technology, know-how, and information of the Employer and its customers (Information) acquired by the Employee either directly or indirectly during the course of employment for the purpose of the employment and shall not disclose such information either during or after termination of this Labor Agreement and shall endeavour to prevent unauthorized disclosure of such information to third parties. The Employee shall not remove any of the Employers goods, documents, files and records without the express permission of the Employer and shall immediately return any such goods on demand. All results obtained by the Employee during the course of and in connection with the performance of the employment obligations shall become the exclusive property of the Employer. When requested to do so by the Employer, the Employee shall enter into any specific undertakings of confidentiality reasonably requested by the Employer. 8.3.(check one) (x) The Employee shall sign the attached Confidentiality Agreement, Exhibit C, which is considered an inseparable part of this Agreement. () Confidentiality Agreement is not applicable. 15. Tax Payments The Employer shall withhold all applicable tax and other obligatory payments, which are payable by the Employee pursuant to applicable legislation from the Employees salary and transfer the deducted amounts as designated.   16. pensions The Employee shall be entitled to pension coverage in accordance with applicable legislation.  
  1. Social Insurance and Medical Services
The Employee shall be provided with social and medical insurance in accordance with applicable legislation.   18. Sick Leave 12.4. The Employee will be entitled to paid sick leave in accordance with applicable legislation. 12.5. The Employee must promptly inform the Employer by calling the immediate supervisory or other designated management employee in the event of illness, incapacity, or accident. The Employee must submit a medical certificate attesting to such incapacity and the probable duration thereof to the Employer no later than the third working day of such incapacity. 12.6. In case of temporary disablement the Employee shall be released from his duties for the duration of his disablement. The Employer does not pay salary during this period. Payments for temporary disablement should be made from insurance contributions in accordance with current legislation   13.Dispute Resolution 13.2 The Employer and the Employee shall attempt to settle disputes arising out of this Agreement means of negotiations. In the event that such attempt should fail, disputes shall be settled in accordance with the Russian Labor Code.     15. Termination and modification of the Labor Agreement 14.5. The present Agreement may be terminated on the initiative of either Party on the basis established by Russian Labor Legislation. 14.6. The Employer shall pay the Employee wages for the time worked, plus compensation for unused vacation pro rata to the time worked and any severance pay due, in accordance with Labor Legislation.   14.7. Terms and conditions of this Labor Agreement can be modified only in written form by agreement between Employer and Employee. 14.8. In the event that any term of this Agreement is held to contravene the applicable laws and therefore is held to be null and void, this does not affect the enforceability of the remaining provisions unless the void provision is considered an essential component of the Agreement.   16. Applicable Law: All other relations of the parties, which are not settled in the present Agreement, are regulated by the labor legislation of the Russian Federation...   This Agreement is signed in two (2) copies, each of the copies is completed in Russian and English languages. How to select the best candidates and avoid the worst?

 

Investing thousands of pounds in the recruitment and training of each new graduate recruit may be just the beginning. Choosing the wrong candidate may leave an organization paying for years to come.

Few companies will have escaped all of the following failures: people who panic at the first sight of stress; those with long impressive qualifications who seem incapable of learning; hypochondriacs whose absentee record becomes astonishing; and the unstable person later discovered to be a thief or worse.

Less dramatic, but just as much a problem, is the person who simply does not come up to expectations, who does not quite deliver; who never becomes a high-flier or even a steady performer; the employee with a fine future behind them.

The first point to bear in mind at the recruitment stage is that people dont change. Intelligence levels decline modestly, but change little over their working life. The same is true of abilities, such as learning languages and handling numbers.

Most people like to think that personality can change, particularly the more negative features such as anxiety, low esteem, impulsiveness or a lack of emotional warmth. But data collected over 50 years gives a clear message: still stable after all these years. Extroverts become slightly less extroverted; the acutely shy appear a little less so, but the fundamentals remain much the same. Personal crises can affect the way we cope with things: we might take up or drop drink, drugs, religion or relaxation techniques, which can be have pretty dramatic effects. Skills can be improved, and new ones introduced, but at rather different rates. People can be groomed for a job. Just as politicians are carefully repackaged through dress, hairstyle and speech specialists, so people can be sent on training courses, diplomas or experimental weekends. But there is a cost to all this, which may be more than the price of the course. Better to select for what you actually see rather than attempt to change it.
