СТАТЬЯ 15- Разногласия / судебные процессы

Статья 13 - Срок действия и прекращение действия

 

13.1. Продолжительность

Соответствующие органы двух университетов могут одобрить настоящий договор после институционального протокола каждого университета. Соглашение вступает в силу с даты последнего подписания и будет действовать в течение пяти (5) лет. При условии, что Соглашение проходит через соответствующий протокол в каждом учреждении. Соглашение может быть продлено, дополнено или изменено путем письменного уведомления, подписанного обеими организациями.

 

13.2. Прекращение

Договор может быть расторгнут по взаимному согласию. Каждая из сторон имеет право расторгнуть Договор в одностороннем порядке.

Договор может быть расторгнут любой из сторон до окончания академического года при условии, что письменное уведомление о намерении прекратить действие договора за шесть (6) месяцев до окончания срока. Обязательства уже в процессе должны быть выполнены, в частности, в отношении к студентам.

 

СТАТЬЯ 14 - Официальный язык

 

14.1. Настоящее Соглашение составлено в двух (2) экземплярах на английском и русском языках, две стороны подписывают в полном согласии, каждый сохраняя одну копию.

 

СТАТЬЯ 15- Разногласия / судебные процессы

 

В случае возникновения спора, связанного с толкованием, применением или выполнением настоящего Соглашения, стороны обязаны обсудить взаимоприемлемое решение.

    Inter-DEPaRTMENT Partnership Agreement BETWEEN FACULTY OF __________ (___________) AND FACULTY OF INFORMATION TECHNOLOGY AND ECONOMICS OF KAZAKH HUMANITARIAN JURIDICAL INNOVATIVE UNIVERSITY (KAZAKHSTAN) Faculty of ___ Located ____ Represented by its Dean_____ Hhereafter referred to as “____” And Faculty ___ of Kazakh Humanitarian Juridical Innovative University, Located Lenin st, 11; 071400, SEMEY, KAZAKHSTAN Represented by its Dean_____ Hhereafter referred to as “KazHJIU” In accordance with the contract of cooperation between ___ dated on the ___________ Given the memorandum of agreement between the two institutions wish to continue cooperation and decide to collaborate on a specific agreement regarding students and faculty exchanges.   The parties agree on the following points: ARTICLE 1 — Objectives of the cooperation The Faculty ____of KazHJIU and the Faculty _______ agree to collaborate on students and faculty exchanges. ARTICLE 2 — Content of the program 2.1. Students The program applies to 2 or 3 level students enrolled in KazHJIU of the Faculty of _____ and in (instituition) at the Faculty_____. Selected students will attend classes of 2 and 3 courses for 2 weeks or 1 semester once an academic year (by mutual agreement of the parties).     2.2. Faculty The program applies to the Faculty ____ KazHJIU and the Faculty of ___. Invited teachers will hold classes at the host university on time and for the period by mutual agreement between the parties - faculty and invited teachers.     STUDENT MOBILITY ARTICLE 3 — Selection 3.1. Selection A contest for applications will be organized each year. The liaison officers in charge of the program will select the students and give their names to the liaison officers of the partner institution. Once the selection process over, the liaison officer will communicate the names of the students selected and their application files to the liaison officer of the host institution. Final acceptance will be the responsibility of the host institution.   3.2.Students enrolled in the program will have to comply with the standard rights and obligations of both institutions, as for instance stipulated in their respective rules of procedure.   3.3. Responsible for the program at each university send the final list of students selected for the internship program of the host Dean of the Faculty, also for the International Department of the host university. 3.4. Selected students will send their applications to the host university following the procedure that the relevant department of the host institution will have given to them for obtaining the visa, by filling in the application form accompanied by the required documents and respecting enrolment deadlines. ARTICLE 4 – Number of students   4.1. The number of students involved in the program cannot exceed 10 (ten) for each institution. The number can be modified before the end of the program if both parties agree.     ARTICLE 5 – Registration fees and expenses 5.1.The selected students will not have to pay any registration fees in the host institution.   5.2. The parties will make sure that the students within the exchange program have appropriate insurance coverage (such as illness, accident). Students will be required to take out Student Social Security coverage in conformity with applicable national regulations in the host country. All persons in mobility must bring liability insurance and repatriation insurance.   5.3. The selected students will have to comply with the health insurance regulations and obligations of both countries.   5.4.Additional subscriptions specific to the host institution (including sports subscriptions, membership of clubs, use of certain sports equipment) shall be borne by the students, as well as individual expenses such as the purchase of books and university equipment, or excursions.   5.5. Students are required to comply with all legal dispositions in force in the host country (visa, etc.).   5.6. Students participating in the exchange program, will pay for travel, visas, health insurance and meals.     ARTICLE 6 – Students’ accommodation 6.1. Students will be provided with lodging by host institution.   ARTICLE 7 - Rights and obligations   7.1. The rights and obligations (including those stipulated by the internal regulations of the institutions and departments concerned) of the students registered in the program are identical to those of the students of the host institution in which they are assigned during the duration of the program.   7.2. The students enrolled in the program will be delivered a student card, and will be granted free access to the libraries.   ARTICLE 8 - Reception and administrative management of the students   8.1. Each institution ensures that the necessary dispositions have been taken for the reception and the administrative management of the students participating in the program. 8.2. To ensure optimum quality reception, the home university must inform the host university of all difficulties resulting from a disability that a selected student might present.     FACULTY MOBILITY ARTICLE 9 – Invitation of scholars for reading lectures. 9.1. Dean of the faculty of the host university beforehand sends an official letter of invitation for the selected scholar - lecturer of the partner institution, which includes the name of visiting scholar, the name of the course / discipline, academic load, timing, lecturing period and additional conditions (optional side). On the basis of this document, a visiting scientist prepares necessary documents to the receiving institution. On the basis of the letter of invitation the host university must accept an invited scholar in accordance with the conditions provided in this agreement. ARTICLE 11 – Financial conditions for inviting scholars. 11.1. The invited scholar receives a basic salary at the home university and has rights and obligations, according to the position held at the university.   11.2. Professors, researchers and others participating in the exchange program will abide by the existing laws and regulations of each country in order to receive their salaries from their home institution, and to benefit from all rights associated with this activity. 11.3. The invited scholar will be provided with food and accommodation by the host university and will receive the salary depending on his academic degree, rank and number of lessons which were conducted.   11.4. Transport costs will be paid by the invited scholar at the expense of the sending university or by scholars. ARTICLE 12 - Correspondence   12.1.
