Financial Arrangements




The Committee as a whole will be responsible for the management of the Clubs funds.

The Committee should ensure that an account is opened in the name of the Club at a reputable bank or building society. The account must have two authorised signatories - the Treasurer and one other nominated member of the Committee. Any credit or debit card associated with the Club must be in the name of a nominated member of the Committee.

The Treasurer is responsible for ensuring that the accounts of the Club are kept up to date.

The Clubs accounts must be submitted for the members approval at the Clubs AGM.

At the end of the financial year, the Club should forward a copy of the accounts to the Supporters Clubs Liaison Officer at Arsenal, who may carry out spot checks to ensure that the information provided is correct.

Records and receipts relating to any financial transactions in which the Club is involved (including, for example, donations to the Club, ticket purchases and product sales) must be kept and made available for inspection by Arsenal on request.

By 31st October each year, the Club must have provided to Arsenal the following:

o a copy of the minutes of the AGM;

o a copy of the accounts from the previous season; and

o the names and addresses of the members of the Club should be loaded onto the relevant section of the Extranet (all such data to be provided in compliance with all relevant data protection legislation).

 

6. Benefits of running a Supporters Club

The Club will be entitled to use a personalised Club crest (the Logo) on its headed paper, membership cards etc. This will be provided to the Club by Arsenal in due course.

The Club (together with its contact details including the address of the Club Website) will appear on the section of the Arsenal website (at www.arsenal.com) dedicated to Arsenal Supporters Clubs.

Specified members of the Club will be entitled to access the Arsenal Supporters Clubs extranet (the Extranet), via which they will be able to contact Arsenal, order tickets and join the Arsenal Supporters Clubs forum and news boards. Information on how to register for the Extranet will be provided to the Club in due course. For details of how to submit requests for tickets via the Extranet, please see Schedule 2.

The Club will have the opportunity to be involved in nominating and presenting a Player of the Year award.

The Club will have the opportunity to appear on the Club Culture page of the match day programmes.

The Clubs members will be entitled to attend stadium tours at times outside of normal opening times (subject to availability)

Nominated representatives of the Club will be entitled to attend twice yearly meetings between representatives of the various Arsenal Supporters Clubs and Arsenal officials.

The Club will be able to produce its own personalised merchandise featuring the personalised Supporters Club Logo. Samples of all such merchandise must be approved by Arsenal in writing prior to such merchandise going into production. If Arsenal requires any changes to the merchandise, the Club must ensure that such changes are made before the merchandise goes into production. Details setting out how to produce personalised merchandise are in Schedule 1.

 

7. Use of the Arsenals Intellectual Property

The Club will bear the name of the geographical area that it represents (name to be determined at Arsenals discretion).

The Club will be provided with the personalised Supporters Club Logo in due course. The Logo will be provided in black, red and gold. The use of the Logo will identify the Club as a club that is officially recognised by Arsenal. The Club is not entitled to use the Arsenal crest.

 

Upon acceptance of these Guidelines, Arsenal grants the Club a non-exclusive, royalty-free licence to use both the Arsenal name and the personalised Supporters Club Logo, only in connection with the business of the Club and in compliance with the requirements set out in these Guidelines.

The Club acknowledges that Arsenal owns all rights in the Logo, and will own any future goodwill in the Logo that is generated by, or in connection with, the Clubs activities.

The Logo must be used only in the form that it is provided to the Club by Arsenal you must not:

o change the colours, images or lines in the Logo;

o crop the Logo;

o position it at an angle;

o separate the elements of the Logo;

o distort or stretch it;

o obstruct any part of the Logo;

o print the logo any smaller than 20mm high;

o print the Logo without accompanying it with the symbol TM at the bottom right of the crest.

The Logo must not be used:

o for or in connection with any overtly political or religious organisation;

o for or in connection with any organisation, whose principal business includes the sale of tobacco related products or pornographic material;

o for or in connection with any organisation carrying on as one of its principal activities the business of venue management, operators of conferences and exhibitions and stadia or providers of consultancy services for stadium management;

o in any manner which conflicts with the applicable British Code of Advertising Practice or any applicable similar code of practice or successor thereof;

o in any manner which primarily depicts men, women or children as sex objects, or depicts or refers to indecency or obscenity;

o in any manner which contains quotations from or references to a member of the Arsenal team unless the written consent of that person or an authorised representative of that person is obtained and is produced to Arsenal; or

o in any manner which encourages in whatever manner or form behaviour which promotes disparaging views or behaviour relating to an individual or groups colour, race, nationality, ethnic or national origins, sex, marital status, religion, age or disability.

If the Club or its members fail to comply with the requirements set out above, Arsenal may withdraw the permission granted in these Guidelines. In such circumstances the Club will no longer be entitled to use the Logo or the Arsenal name.

 

8. Members personal data

The Club should collect all members names and contact details, so that it can keep members up-to-date with the activities of the Club and information provided to the Club by Arsenal.

The Club must deal with all personal data (such as names, addresses and telephone numbers) that is collected from its members in accordance with all current rules and regulations regarding data protection including the Data Protection Act 1998 (as amended).

When the Club collects personal data from its members, it must ask them whether they would like such information to be passed onto Arsenal so that Arsenal is able to (i) provide them with information regarding Arsenal Football Club; and (ii) provide them with offers and information regarding third party products that it believes they may be interested in.

The Club cannot pass members personal data onto Arsenal unless it has their permission to do so. When the Club does pass members personal data onto Arsenal, it must inform Arsenal what type of consent that member has given (i.e. (i) or (ii) above).

The Club should ensure that all membership application forms that it uses contain the following wording:

  I would like to receive information regarding Arsenal Football Club, and details of products and services by email, telephone and/or post from The Arsenal Football Club Plc and its holding company, subsidiaries and associated companies and joint ventures (Arsenal).
  I would like to receive offers and information by email, telephone and/or post from Arsenal about specially selected third parties and partners.

 

The Club remains legally responsible for its compliance with all applicable data protection legislation.

 

 

9. The Clubs responsibilities

The Club is responsible for:

o updating its members with any news alerts communicated to the Clubs Committee members by Arsenal via the Arsenal Supporters Clubs Extranet.

o providing members names and contact details to Arsenal via the Extranet, if consent has been given, and ensuring that it updates Arsenal with any changes to members names and addresses;

o promoting Arsenal products and services on behalf of Arsenal; and

o helping Arsenal to extend its worldwide supporter base.

The Club may not indicate, beyond being an authorised Club for Arsenal supporters, that it is connected in any way with Arsenal.

The Club must not attempt to enter into any agreement on Arsenals behalf.

 

 

The Club must display the following disclaimer on all Club correspondence:

The [insert name of the Club] is independent of The Arsenal Football Club PLC (Company no: 109244) and its associated and group companies, and has no authority to bind, contract or negotiate on its behalf.

The Club acknowledges that Arsenal shall not be liable for any damage, loss or harm caused to the Club, the members of the Club, or any third party, by any activities of the Club.

The Club must not do anything that will cause harm to or damage the reputation of Arsenal or its trade marks.

The Club must at all times comply with these Guidelines, including the Schedules.
