Dear Mr. As it comes from your order (act. document) the m/v " " which is under my command has been detained in the port and found allegedly incompliant with requirements of the "Memorandum of Understanding on Port State Control 1982". Under the circumstances I have to make an official statement that living and working conditions are ensured on board my ship. These conditions are in conformity with Russian (Ukrainian) legislation, terms of collective bargain, provisions of international agreement to which Russia (Ukraine) is party. The inspection has not detected any deficiencies which are clearly hazardous to safety, health or the environment, so the detention of my ship is quite groundless. Moreover. I would like to draw your attention to the fact that according to universally recognized norm of international laws multilateral treaties are obligatory to be observed and followed by their parties only, while Russia (Ukraine) is not party to the "Memorandum of Understanding of Port State Control 1982". In view of the above I, the Master of the m/v " consider the detention of my ship in the Port of inspection as illegal so I am lodging this protest demanding to disaffirm your decision.
